CITY CODE 12-205 STATES LITTERING OF STREETS UNLAWFUL
It shall be unlawful for any person or persons to place, throw or deposit or cause to be placed, deposited or left any dirt, filth, sweepings, excrement, compost, papers, boxes, ashes, lumber, coal, wood, kindling, grass, weeds, leaves, slops or litter of any kind in or on any streets, alleys, parks or public ways of the city.CITY CODE 12-210, PENALTYAny person violating any of the provisions of this article shall, upon conviction thereof, be fined in any sum not exceeding One Hundred Dollars ($100.00) , or be imprisoned not to exceed thirty (30) days, or be both so fined and imprisoned.BURN PITIn a letter dated January 11, 2002, received at the City Office from the Kansas Department of Health & Environment, we were informed that ONLY TREES AND BRUSH ARE PERMITTED TO ACCUMULATE AND BE BURNED AT THE SITE.
Trees and brush are exactly that.... Leaves may be attached to trees, if they are dried. However, green leaves attached to trees or brush are NOT allowed. The city council directed the City Clerk to have the maintenance employees fill in the burn pit at the burn site and change the signs to state only trees and brush are allowed — no clean lumber.
Citizens who are used to bagging their leaves to take them to the burn pit or gathering loose leaves in truck beds to take to the burn pit.... may continue to do so. However, these are to be dumped in the compost pile and composted, not burned.
KDHE recommends, and promotes, composting of yard waste. Further, should the Department observe the open burning of waste materials in violation of the regulations, the Department may revoke burn pit approval and initiate enforcement actions. K.S.A. 65-3018 provides for the assessment of monetary penalties and /or other enforcement actions. |
